The Seven Principles Every Organisation Must Live By
Across every major jurisdiction, from New Delhi to Brussels to Washington, the same seven principles keep emerging. The terminology varies. The underlying requirements converge.
Legality
Every AI system must operate within the boundaries of applicable law. This is not merely about avoiding illegality but proactively ensuring that AI outputs, decisions and recommendations can withstand legal scrutiny.
Map all AI systems against applicable regulatory requirements. Maintain a living register that tracks regulatory changes across jurisdictions where the AI operates.
Organisations often discover their AI systems violate laws they never considered. A recruitment AI may inadvertently breach disability discrimination laws by screening out candidates with employment gaps caused by medical leave.
Accountability
Clear chains of responsibility must exist for every AI decision. When an AI causes harm, there must be a human being who can be held accountable, who understood the system's limitations, and who had authority to intervene.
Establish AI governance committees with board level oversight. Define AI owners for each system with documented authority and responsibility boundaries.
The "AI did it" defence is collapsing in courts. When Post Office Horizon software wrongly accused postmasters of theft, lack of accountability led to one of Britain's worst miscarriages of justice affecting 700 people.
Safety
AI systems must not cause physical, psychological or financial harm to individuals. Safety extends beyond obvious harms to include subtle impacts like algorithmic addiction or decision fatigue.
Conduct pre deployment safety assessments. Establish kill switches and human override capabilities. Monitor for emergent harmful behaviours post deployment.
Tesla's Autopilot has been linked to over 700 crashes since 2019. The core issue was not technology failure but overconfidence in automation leading to human disengagement at critical moments.
Security
AI systems present unique security vulnerabilities including adversarial attacks, data poisoning, model extraction and prompt injection. Traditional cybersecurity is necessary but insufficient.
Red team AI systems specifically for AI attack vectors. Implement model monitoring for drift and poisoning. Secure training data pipelines as critically as production systems.
Microsoft's Tay chatbot was corrupted within 16 hours of deployment through coordinated adversarial inputs, demonstrating how AI specific attacks can bypass conventional security measures.
Transparency
Affected individuals must understand when AI is being used, how decisions are made, and what recourse exists. Transparency is not about revealing trade secrets but about enabling informed consent and challenge.
Maintain model cards documenting capabilities, limitations and intended uses. Provide meaningful explanations calibrated to audience sophistication. Enable affected individuals to request human review.
The Dutch childcare benefits scandal used an algorithm to flag fraud that officials could not explain. 26,000 families were wrongly accused, leading to the government's resignation.
Fairness
AI systems must not discriminate on prohibited grounds or perpetuate historical biases. Fairness is context dependent: what constitutes fairness in lending differs from fairness in healthcare.
Define fairness metrics appropriate to each use case. Test for disparate impact across protected characteristics. Monitor for bias drift as data distributions change.
Amazon scrapped its AI recruitment tool after discovering it penalised CVs containing the word "women's" because it was trained on 10 years of predominantly male hiring data.
Human Oversight
Humans must retain meaningful control over AI systems, particularly for consequential decisions. This means more than a rubber stamp: oversight must be informed, resourced and empowered to intervene.
Design human in the loop for high stakes decisions. Ensure reviewers have time, training and authority to override AI recommendations. Audit override patterns for rubber stamping.
Uber's self driving car killed Elaine Herzberg in 2018 partly because the safety driver was watching videos on her phone. Nominal human oversight without genuine engagement provides false assurance.
