The Act's provisions on data principal rights, fiduciary obligations, and consent architecture have profound implications for every organisation deploying AI systems that touch personal information.
The Consent Paradigm Shift
At the heart of the DPDPA lies a consent framework that AI practitioners cannot ignore. Consent must be free, specific, informed, unconditional, and unambiguous. For AI systems, this requirement creates immediate operational challenges. How does one obtain "specific" consent for machine learning processes whose outputs cannot be precisely predicted? How does one provide "informed" consent when the complexity of neural networks defies lay explanation? These questions admit no easy answers, but ignoring them invites regulatory action.
The Act's requirement for purpose limitation compounds the challenge. Consent must specify the purpose for which data will be processed, and processing must remain within that specified purpose. AI development, however, often involves iterative exploration. A model trained for one purpose may reveal insights applicable to another. The repurposing of training data, common in machine learning practice, must now navigate purpose limitation constraints that the technology was not designed to respect.
Rights of the Data Principal
The DPDPA grants data principals a suite of rights that AI systems must accommodate. The right to access requires organisations to inform individuals about what personal data is being processed and for what purposes. When AI systems derive inferences from personal data, do those inferences themselves constitute personal data subject to access rights? The answer has significant implications for explainability requirements.
The right to correction requires data fiduciaries to correct inaccurate or misleading personal data. For AI systems, this right extends beyond raw input data to model outputs that affect individuals. If a credit scoring algorithm produces an inaccurate assessment, the data principal may have rights to correction that require model recalibration, not merely data amendment. The operational implications are substantial.
The right to erasure presents perhaps the most significant technical challenge. Machine learning models encode information from training data in their parameters. True erasure may require model retraining without the subject's data, a computationally expensive proposition that scales poorly. The emerging field of machine unlearning offers potential solutions, but the technology remains immature. Organisations must plan for erasure requests with incomplete technical tools.
Fiduciary Obligations
The DPDPA introduces the concept of the data fiduciary, an entity that determines the purpose and means of processing personal data. This fiduciary framing carries significant implications. Fiduciaries owe duties of care, loyalty, and good faith. They must act in the interests of those whose data they hold, not merely refrain from causing harm. For AI systems, this duty may require design choices that prioritise individual interests over operational efficiency.
Significant data fiduciaries face enhanced obligations, including the appointment of data protection officers, conduct of data protection impact assessments, and periodic audits by independent auditors. AI systems deployed at scale will likely trigger significant fiduciary status. The compliance architecture required is substantial, extending from technical controls to governance frameworks to audit mechanisms.
Consent Managers and Infrastructure
The Act introduces consent managers as intermediaries enabling data principals to manage consent across multiple data fiduciaries. This infrastructure has profound implications for AI systems. Consent withdrawal must propagate to all downstream processing, including AI training pipelines. Consent managers must maintain records enabling this propagation. The technical integration required connects consent management systems to data processing pipelines in ways that current architectures may not support.
Organisations deploying AI should anticipate consent manager integration requirements. APIs must enable consent status queries. Data pipelines must respond to consent withdrawal signals. Training processes must accommodate dynamic consent states. These requirements impose architectural constraints that are far easier to address during system design than through retrofitting.
Legitimate Uses Without Consent
The DPDPA recognises certain legitimate uses that do not require consent, including compliance with legal obligations, performance of state functions, medical emergencies, and employment purposes within specified limits. AI systems may process personal data under these bases without individual consent. However, the legitimate use basis must genuinely apply; it cannot serve as a convenience loophole to avoid consent requirements.
The employment exception warrants particular attention. Employers may process employee data for employment purposes without consent, but the scope of "employment purposes" has limits. AI-driven performance monitoring, predictive attrition analysis, and workforce optimisation algorithms operate in grey zones. The prudent employer documents the employment nexus for each AI application and maintains records demonstrating legitimate use.
Enforcement and Penalties
The DPDPA's penalty framework provides substantial enforcement teeth. Violations can attract penalties up to INR 250 crore, depending on severity and the provision breached. For AI systems processing personal data at scale, the aggregate exposure is significant. A single algorithmic failure affecting millions of data principals could generate penalties that threaten organisational viability.
The Data Protection Board of India will adjudicate complaints and impose penalties. While the Board is newly constituted and its enforcement priorities remain to be established, prudent organisations assume active enforcement. The combination of substantial penalties and uncertain enforcement creates a risk profile that demands proactive compliance rather than reactive response. For AI practitioners, DPDPA compliance is not an afterthought but a design constraint.
