Algorithmic harm often manifests at scale, affecting thousands or millions of consumers through the same algorithmic mechanism. This makes class actions a natural vehicle for algorithmic accountability. A pricing algorithm that overcharges systematically, a recommendation system that misleads consistently, or a credit model that discriminates uniformly all invite class action response.
Indian class action jurisprudence remains underdeveloped compared to jurisdictions like the United States, but the statutory framework exists. The Central Consumer Protection Authority can initiate investigations and issue orders affecting classes of consumers. The same practices that satisfy consumer protection requirements, such as transparency, fairness, and recourse, also advance compliance with sector-specific regulations, data protection law, and competition norms.
